These terms of sale (“Terms”) apply to all orders accepted by Conzumex Industries Pvt. Ltd. (hereinafter “Muse”) for the sale of physical goods (“Products”). To the extent the Products contain or consist of software in any form (“Software”), such Software is licensed to you, not sold, and only in accordance with the section entitled “Software License”, below. Terms such as “sell” and “purchase”, as used in these Terms, apply only to the extent the Products consist of items other than Software. By making a purchase from, and using, this website you have agreed to these terms of use. Please make sure that you have read and understood these terms of use when using our site.

ORDERS

You can browse and place orders for our Products through, https://www.musewearables.com (the “Muse online store”). We’ll ask you for your name, phone number, e-mail address, shipping and billing address, and other information, so we can fulfill your order. When you place an order, Muse’s third-party payment service provider will collect your card details and charge your card account in connection with the order, and you agree to make all applicable payments in connection with any order placed by you. Muse does not view or store your card information. We store your shipping address and contact information so we can process your order through our fulfillment partner. If you are logged into your Muse account when you purchase something from the Muse online store, we associate that order with your Muse account. By placing an order through the Muse online store, you agree that: (i) any credit card information supplied by you is true and complete; and (ii) you will pay the applicable price listed, as well as any shipping and handling charges and applicable taxes. Products purchased by you are for personal or gift use and not for commercial use.

CONFIRMATION

Once we have received your order we will send an electronic invoice to your e-mail address as a confirmation of your purchase. It is important that you enter the correct e-mail address when placing your order. We recommend saving this email in order to facilitate any contact with customer service you may have in the future. The order confirmation (receipt) also serves as guarantee of proof of purchase.

PRODUCT INFORMATION

Muse has the right to adjust prices, involve additional cost and change product information such as product pictures and offers without notice. The product images and information texts available reflect the product as much as possible. We reserve the right for any errors that may appear on the page and cannot guarantee that all pictures accurately reflect the true appearance of the watch. The pictures may differ depending on the color settings in your computer. All pictures should be seen as illustrations only, and do not guarantee correct appearance and characteristics.

SHIPPING AND CANCELLATIONS

Muse will pack the Products in accordance with its standard practices. You can choose the method of shipment and timing of delivery for Products ordered, and will be charged shipping and handling charges accordingly. Title to the Products (except to the extent that the Products consist of Software) and risk of loss will pass to you upon Muse’s delivery of the Products to the carrier. Muse ships worldwide. Fulfillment's are made in cooperation with the postal services and their partners .You acknowledge that all scheduled shipment dates are estimates only. Muse will make reasonable efforts to meet the scheduled shipment dates, but in no event will Muse be liable for any loss, damage, or penalty resulting from any delay in shipment or delivery.
Customers have the right to cancel purchases and return delivered goods by contacting Muse’s customer service or using the contact form on Muse’s website within 15 days from receiving the goods https://www.musewearables.com/pages/contact-us, provided the goods are unpacked and in the same condition as when you received them. However, the customer is responsible for the cost and risk for transporting the returned goods to Muse.
When the order has been dispatched, the customer is required and responsible to receive the order. Cancellation is not valid until the customer has confirmed with Muse either by email. If a product has been discontinued Muse has the right to cancel the purchase and refund the paid amount to the customer. Muse will notify the customer of a replacement or equivalent products if available.

RESALE

Purchases made through the Muse online store are intended for end users only, and are not authorized for resale.

COMPLAINTS TERMS

It is important that you as a customer carefully check your goods / products when you receive your shipment in order to verify that the products are not damaged and correct. If your product is damaged in transport, whether the damage is visible or hidden, you must report this as soon as possible to the carrier. If you receive your item and see that it is damaged or does not match the one you ordered or, you shall also contact us within 15 days from receiving the product.
Any complaints shall be made to our customer service through our contact form on the contact page. Please supply the order number and the reason for complaint and we will get back to you shortly with instructions on how to return the item. Defective products returned to Muse should be treated as if they were faultless. It is in all types of returns extremely important that the product is packaged in such a way that it cannot be damaged during transit. In the case that a returned product has no errors or faults. Muse has the right to replace defective goods with goods of the same model. If the item has been discontinued, the customer will receive a full refund.

COMPATIBILITY

You acknowledge that you have verified the compatibility of the Products you are purchasing with other required equipment (e.g., ensuring that your mobile device and/or operating system is compatible with the Product). You are solely responsible for determining the compatibility of the Products with other equipment, and you accept that lack of compatibility is not a valid claim under the warranty provided with your Products and does not otherwise constitute a basis for receiving a refund.

SOFTWARE LICENSE

Muse grants to you a nonexclusive, non-transferable license to use the Software, in executable form, solely as embedded in the Products, solely for your internal, non-commercial use. You may not copy or modify the Software. You acknowledge that the Software contains trade secrets of Muse, and, in order to protect such trade secrets, you agree not to disassemble, decompile or reverse engineer the Software nor permit any third party to do so, except to the extent such restrictions are prohibited by law. Muse reserves all rights and licenses in and to the Software not expressly granted to you under this Agreement.

ADDITIONAL INFORMATION

No transmission of data over the internet is guaranteed to be completely secure. It may be possible for third parties not under the control of Muse to intercept or access transmissions or private communications unlawfully. While we strive to protect your Personal Information, neither Muse nor any of our service providers can ensure or warrant the security of any information you transmit to us over the internet. Any such transmission is done at your own risk.

LIABILITY

Muse responsibility for errors in connection to delivery is limited to existing conditions of sale. Muse bears no direct or indirect responsibility for example, but not limited to, incompatibility, delivery delays, downtime, data loss, additional work or other economic harm.

FORCE MAJEURE

Any event that is deemed at once unforeseeable, insurmountable and external and thereby prevents us from fulfilling our obligations under these Muse Services Terms and Conditions is considered an event of Force Majeure (“Force Majeure Event”). The following events are especially considered as examples of Force Majeure Events: strikes, flood, fire, lock-outs, disruption and distractions in transport services, supply difficulties in raw material or energy, any communication interference resulting in any difficulty to fulfill any order or performance of any act required by the Muse shall be suspended for the duration of the Force Majeure Event. The performance of such act shall be immediately continued once the cause of the Force Majeure Event ceases.

GOVERNING LAW – DISPUTE RESOLUTION

These Muse Services Terms and Conditions and all any action related thereto shall be governed, controlled, interpreted by and construed in accordance with the laws of the Tamil Nadu State (INDIA) without regard to principles of conflict of laws.

TERMINATION

Muse reserves the right to terminate your account and/or your use of the https://www.musewearables.com website at its sole discretion. For example, if Muse suspects that you have breached these terms of use. Such termination can be made without prior notice.

AMENDMENTS

Muse may revise these terms of use from time to time. Every time you order a product from us, the general conditions in force at that time will apply to the contract between you and Muse. You should therefore periodically visit this page to review the then current terms to which you are bound.
